Responsibilities of the Town Attorney's Office
The Town Attorney's Office is the principal legal advisor to the Town Board and all town departments. This office represents the town in all legal matters affecting the town's interests. The town attorney is also responsible for drafting resolutions, local laws, and ordinances for the Town Board.
Effective, Monday, August 15, 2022, all divisions of the Town Attorney's Office listed below are now located in the Town of Babylon Municipal Building at North Amityville, located at 456 Albany Avenue, Amityville. The Town Attorney's Office is still located in Babylon Town Hall, 200 East Sunrise Highway, Lindenhurst.
Parking Violations Bureau
The Parking Violations Bureau is responsible for processing of violations of parking laws, ordinances, rules and regulations. Parking tickets can be issued for a variety of reasons, including but not limited to, unauthorized parking in handicapped parking spots or parking illegally in fire zones.
Parking Permit Office
The Parking Permit Office is responsible for the issuance of parking permits for all Babylon Town-maintained parking spaces at the Copiague and Wyandanch Long Island Rail Road (LIRR) commuter lots. These permits prevent non-Town of Babylon residents from parking on Town commuter lots. Yearly permits are valid from January 1 to December 31 of each year.
Abandoned Vehicle Unit
The Abandoned Vehicle Unit is responsible for the removal, redemption and disposal of abandoned vehicles seized by the Town for being in violation of the Town of Babylon Uniform Code of Traffic Ordinances.

Summonses are written by either Suffolk County Police, Town of Babylon Public Safety Officials, or Park Rangers for all New York State and Town violations that exist while a vehicle is parked on a public street. Violations include, but are not limited to:
- Handicapped Parking Zone
- Fire Zone
- No Parking
- Expired Registration
- Expired Inspection
Fines must be paid and received by the Town within 30 days of the ticket in order to avoid penalties. Fines can be paid in person, online at Parking Ticket Payments, or by mail. If paying by mail, make check or money order payable to the Town of Babylon and write your license number and the ticket number on the front of the payment to ensure proper credit. Anyone who receives a parking violation has the option to plead not guilty on the back of the summons and then mail it back to the Parking Violations Bureau. Those who plead not guilty will receive a letter setting you up for a conference with our parking violations attorney.

Yes, there is $100 fine for parking without a permit. There is also a metered lot available at the Copiague Train Station that charges $3 for 24 hours.

The parking garage is managed by the MTA, not the Town of Babylon. Please contact the Long Island Rail Road for more information on the garage and fees to use it.
- How long are parking permits valid for?

Parking Permits issued by the Town of Babylon are valid from January 1st to December 31st of each year.
- How do I get a permit for the Amityville, Babylon or Lindenhurst LIRR stations?

The Villages of Amityville, Babylon and Lindenhurst all issue parking permits for the LIRR stations within their respective jurisdiction. Please call the Village Hall you are looking to obtain a permit from.

- How do I report an abandoned vehicle ?

To report an abandoned vehicle to the Town of Babylon, please call the Office of Citizen Services by dialing 3-1-1 or (631) 957-7474. You can also fill out the Report a Concern form. Please be as descriptive as possible when describing the vehicle and its location.
- How do I claim an impounded vehicle?

The Abandoned Vehicle Unit release cars Monday thru Friday between the hours of:9:00 a.m. - 12:00 p.m. and 1:00 p.m. - 2:00 p.m.
Only the titled owner will be able to reclaim the vehicle.
The titled owner must appear with the title, identification and form of payment (call ahead to confirm amount) and their identification during the above hours at the front lobby of the Town of Babylon Municipal Building at North Amityville, located at 456 Albany Avenue in Amityville.
If the owner of the vehicle is a corporation, only an Officer of the Corporation can reclaim a vehicle and must present proof of relationship to the corporation such as corporate books, tax return or state incorporation papers.
If the reclaimed vehicle is not registered, it must be towed from the impound by a Babylon licensed town truck. We will provide a current list of approved companies. Tow driver will meet the owner at the Department of Public Works impound lot located at 1023 N. Indiana Avenue in Lindenhurst after the paperwork is complete and fee paid.
Vehicle owner will be handed two copies of the release form. One copy for their records, and one to give to the DPW employee releasing the vehicle at the impound.

Automobile - $150 plus $75 per day storage, $225 if claimed on day of tow
4-6 Wheel Truck - $200 plus $100 per day storage, $300 if claimed on day of tow
6-8 Wheel Truck - $300 plus $150 per day storage, $450 if claimed on day of tow
8-16 Wheel Truck - $400 plus $200 per day storage, $600 if claimed on day of tow
Tractor or Trailer - $500 plus $250 per day storage, $725 if claimed on day of tow
16 Wheel & above - $600 plus $250 per day storage, $850 if claimed on day of tow

Vehicles that have been towed or impounded by the Town of Babylon can be retrieved once an abandoned vehicle release form has been signed and notarized by the Town of Babylon Auto Impound Department. Only the titled owner will be able to reclaim the vehicle:
- The titled owner must appear at the Abandoned Vehicle Unit, 456 Albany Avenue, Amityville, with the title and ID before 2:00 pm to obtain a release form to reclaim the vehicle.
- The titled owner must also have a tow truck driver, licensed to tow in the Town of Babylon, meet them at the DPW after the paperwork is complete.
- The notarized release form is brought to the Town Clerk's Office and the fees must be paid in cash. You will receive a receipt and a copy of the release form.
- The documents are then brought to the Department of Public Works located behind Town Hall.

- What is a FOIL request?

A Freedom of Information request (FOIL) is a request for access to Town Records pursuant to the Freedom of Information Law (Public Officers Law, article 6 sections 84-90). Once the request form is received by the Town Clerk via fax or in person, the Town Attorney reviews the request with subject area personnel. The law pertains to records only. It is not intended for examination of employees or officials. The Town is not required to create a new record in response to a question or questions. The Town may seek clarification of the requested information and may reasonably decline to honor a request that is not descriptive enough within the context of the Town's record keeping system. All records are available, unless an exception permits an agency to deny access. Common sense and the potential for harm that might arise from a specific disclosure, such as that which could preclude the government from carrying out its duties, are things that could limit disclosure.

Once the request is made and requested information is compiled by the subject area department, it is forwarded to the Town Clerk's Office and the requester is notified that the information is available. Once the request is filed with the Town Clerk's Office, it is reviewed by the Town Attorney's office. These requests are typically returned within 20 business days.
- Can I make a FOIL request for property information?

FOILS can be filed for property information by non-owners as per usual procedures. Property owners do not need to file a FOIL request to get information pertaining to property they own (and can show proof). If a Certified Certificate of Occupancy is required, the application can be filled out by the property owner in the Department of Planning & Development's Building Division. Certified documents usually take about 2 weeks to be prepared.
